Supply of Liquor to Minors
It is illegal for us to sell alcohol to you if you are under the age of 21 Year Old. It is illegal for you to buy alcohol from us if you are under the age of 21 Year Old and it is illegal if you falsify your details in order to buy alcohol if you are under the age of 21 Year Old.
Non-Sales of Alcohol to Muslims
By virtue of Section 19 (1) and Section 19 (2) Syariah Criminal Offences Act 1997, all Malaysian Muslims are forbidden from buying and drinking alcohol.
In accordance to the legal provisions above, Adult Food and Beverage will not sell any alcohol products listed on its website to any Malaysian Muslims.
Pricing, Orders & Payment
Adult Food and Beverage reserves the right to alter prices at any time. All prices quoted are in Ringgit Malaysia (RM). We endeavour to supply advertised vintages, quantities and pricing, but all orders are subject to availability and confirmation by Adult Food and Beverage. If any product ordered is unavailable or incorrectly priced we will contact you and advise you of the correct price, or recommend a suitable substitute. All goods remain the property of Adult Food and Beverage until payment has been confirmed. We reserve the right to limit any sale.
Minimum Order Quantity
There is no minimum order quantity.
Delivery
Delivery will be charged accordingly. Please refer to our Shipping Policy.
Product and Packing Guarantees
Please note that damaged goods and delivery errors must be reported within 24 hours of delivery. If your order has been packed incorrectly and is not what you have been invoiced for, we will put it right for you. Please note that packing errors must be reported within 24 hours of delivery. If you receive faulty product/s, we will replace it for you or credit your account. If a product is found to be defective or damaged during shipping, Adult Food and Beverage shall not be liable or responsible for it
Product’s description and information
Please note that all product’s description and information may not be 100% accurate. Eg. Tasting notes and alcohol by volume (ABV%) may vary depends on vintage and sommelier’s experience and knowledge or personal preferences. Furthermore, the product’s image may not be absolutely accurate as well due to changing label or packaging by producers. Do not worry if you received a product which is not match with the image in our website. However, if you do have any doubt regarding the product, do not hesitate to contact us immediately.
Pricing Information
We make every effort to correctly display our prices on this website. However if a price is incorrect we reserve the right not to proceed with your order at that incorrect price. If a product that you have ordered has been incorrectly priced, we will call you to give you the option of paying the correct price or cancelling your order. Prices shown against each item listed are not inclusive of postage and packaging which will be added to the bill.
Cancellation
The customer holds the right to cancel any order made at Adult Food and Beverage.
We will be happy to provide a full cancellation order within 24 hours or immediately since the purchase.
Adult Food and Beverage reserved the right to cancel orders that we are unable to fulfil, due to stocking issue or any errors occur during the transaction of order that are within 24 hours as informed.
Indemnification
You shall indemnify and save harmless Adult Food and Beverage and its officers, directors, employees, consultants, representatives and agents from and against any claim, cause of action or demand, including without limitation reasonable legal, accounting and other professional fees, brought as a result of your use of the websites.
Governing Law
This Agreement and its performance shall be governed by the laws of Malaysia. You consent and submit to the exclusive jurisdiction of the courts and administrative tribunals, as the case may be, located in the City of Edmonton, in Penang, Malaysia, in all disputes arising out of or relating to the use of the websites and these Terms and Conditions.
Severability
These Terms and Conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
Headings
The headings used in these Terms and Conditions are included for convenience only and will not limit or otherwise affect these Terms and Conditions.
Entire Agreement
These Terms and Conditions, together with those incorporated or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by Adult Food and Beverage making such amendments or modifications available to it pursuant to the Terms and Conditions.
